18 U.S.C. § 2257 Disclosure

Barely Dating is a dating site which allows the uploading, sharing and general viewing of various types of adult and non-adult images.  While Barely Dating does the best it can to verify compliance, it may not always be 100% accurate.

Barely Dating abides by the following procedures to ensure compliance:

  • requiring users to be at least 18 years of age;
  • requiring users to upload only images of themselves;
  • requiring users to submit valid government-issued photo ID where there is any doubt.

Barely Dating distances itself from any legal copyright action taken: it is fully upon the users of Barely Dating to verify the ownership of the uploaded material.

Barely Dating allows content to be flagged as inappropriate by other users.  Should any content be deemed illegal, unlawful, harassing, harmful, or offensive, Barely Dating shall remove it from the site.

Exemption :: Content Produced by Third Parties

Barely Dating is not the "producer" (primary or secondary) of any and all depictions of actual or simulated sexually explicit conduct submitted by its third party users / members.  Instead, the activities of the operators of barelydating.com, with respect to such content, are limited to the transmission, storage, retrieval, hosting and/or formatting of depictions posted directly to the Website by third party users, on areas of the Website under the user's control.

Pursuant to Title 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. 230(c), the operators of barelydating.com reserve the right to delete content posted by users which operators deem to be indecent, obscene, defamatory or inconsistent with their policies and terms of service.

Exemption :: Content Produced by Website Operator

With regard to all visual depictions appearing on barelydating.com for which the operators are producers, such depictions are exempt from the provision of 18 U.S.C. § 2257 and 28 C.F.R. § 75 because:

  1. they do not portray actual sexually explicit conduct as specifically defined in 18 U.S.C. § 2256 (2)(A)(i)-(iv);
  2. they do not portray depictions of the genitals or pubic area created after July 27, 2006;
  3. they do not portray simulated sexually explicit activity created after the effective date of Title 18 U.S.C. § 2257A; or,
  4. they were created prior to July 3, 1995.
